      Sorry I missed this - ok so it appears each time you've made a large order they've opened a new account, usually this is done as a result of an offer such as buy now pay later.... how much was the goods you ordered, from the statements? ie was it a BNPL or was it small items that wouldn't qualify? That would help - but I think the start date should remain 2006, as you're one person and their own terms only allow one account per user so UNLESS you paid one off and closed it, then reapplied, the start date will always be the date that you first ordered anything.

        Yes it makes sense, how you explain it

        The thing is is that the Littlewoods account i opened in 2006 never had any outstanding balance. i ordered a dress online...they accepted me and gave me a credit limit of £900.....the dress was awful so i sent it back. I didn`t sign any cca or anything and never ordered anything else, although they did send me a catalogue. So there was never any outstanding balance on this account, and they never sent me any more statements.

        Fast forward to August 2008....

        I again ordered some goods online from Littlewoods to the value of £76.00, they weren`t BNPL. They arrived and i kept them. They sent me a cca which i signed and returned to them. I never realised this account number was different from the previous one ( as i never used the other account after sending that first dress back). These goods were ordered and sent to the same address as in 2006 but in my married name, the first account was opened in my maiden name.

        Oh its a headache!!!

        So technically i didn`t close that first account and then reapply, but i never used it either.
        I`m inclined to think that i should disregard that first account as there was never any balance owing, however if it was a credit card...? then the cca would have applied from 2006 whether i had used it or not before 2008 wouldn`t it?

        Hope that makes sense?

            The more i look at all this SAR info the more i find!

            The one sheet of paper that states the info for the account opened in 2006 says (amongst other abbreviations i can`t understand):

            Last Order: 180206
            Last Statement: 030813
            Acc clear Date: 250306

            So now i`m even more confused

              lol course it makes sense

              ok I'd agree that 2008 is the actual start date and not 2006 based on the main fact there were major differences plus you did sign a cca. For now leave that to one side and deal with cca's. I'll come back to you on this, later - I have the police here regards a separate issue that requires my immediate attention.

                    Ooops sorry just realised we need to sort SDG.

                    Just remind me again, did you ever CCA them? If not send a s.78 request as that'll stop them trying to take action against you. If you did cca them, when did you do it?

                      Hi Niddy.

                      I sent Lowells a CCA request in July and emailed you it when i first joined the forum. It was enforceable. I never CCA`d SDG though. I sent a SAR to them which i received in August.

                      I`ve received a letter from Lowells over the weekend saying that they assume i am unwilling to repay the money i owe and that they are going to obtain a copy of my credit file and either use the courts or send the door step agent to visit me

                      They`ve given me the option of completing the direct debit mandate to set up repayments if i prefer not to speak to their staff!

                        Hrmmmm ok as we're assuming it's post 2007 that does change things slightly however I'm surprised lowells are being so aggressive over a small debt.

                        I'll sort a reply to Lowell for you later. Try not to worry.

                          Yes hubby and i have a mortgage for our house....Lowells already have a CO on it for one of hubby`s old debts - the barstewards!!! They never hassle us about it though...well they haven`t for a year or two anyway.......

I am not prepared to pay into this account because SDG have acted totally unprofessionally and I have a very valid dispute which is ongoing. You making these silly threats does little but irritate me and confirm that the stance I am taking is the correct one. If you issue a claim let me tell you now it will be passed to my solicitor to defend with a counterclaim plus costs, as it would clearly be a vexatious claim based on bullying.

                            I have requested a SAR in line with s.7 Data Protection Act and the information sent to me from SDG is not only confusing, but clearly shows that there are various errors, including but not limited to around 25 default entries appearing on my credit report as well as total ambiguity over the actual commencement date of the alleged account in question.

                            I urge you to pass this account back to SDG or to issue a claim, forthwith, as I will not put up with your bullying tactics any longer. I have nothing more to say to you, albeit I am more than happy to try and resolve matters directly with SDG if they actually start answering the questions I put to them instead of just referring it back to you.

                            This is my final communication to you, the next letter will only be a formal letter of complaint based on the above points. There is a valid dispute in line with the OFT's guidelines on debt collection and until such time the dispute is resolved, formal action should not be taken. Ask your contact at SDG to respond to my last letter and send a copy of this to them, maybe then we can resolve the issue of when this alleged account was actually opened because in one letter they claim it was in 2006 and in another they claim 2008. How is that possible, exactly?

                                Don't worry about lowells. Yea they are claim happy but we enjoy spanking them as well so it's a catch-22 for them. Now they're aware of a dispute that does fall inside OFT Guidelines, if they issue an SD now you'll spank them all the way to the bank hence you're kinda saying in the letter, bring it on.

                                25 defaults alone puts it into dispute. Idiots!!
